Can I make the Doc Theme's customized "Header" section non-scrolling?

I am using the Documentation theme in a space. I have gone into the "Configure theme" panel in the Space Admin section and added markup for a horizontal menu in the "Header" field. The menu comes up correctly, but I find that on longer pages it scrolls up out of sight as the user scrolls down the page. Is there any way to make the content in the "Header" field non-scrolling?

First question: Which version of confluence do you use? (your question is quite old, so it might be outdated.)
The documentation theme i.e. in Confluence 5.5(.3) has a static header bar. #header is block and static. Perhaps it's a good day to upgrade?! ;)
